Proceedings below: The district court overruled Appellant’s motion to suppress his statements to police. After a jury trial, Appellant was adjudged guilty of murder in the first degree, and tampering with physical evidence. He was sentenced to life imprisonment without parole for murder in the first degree and two to two year’s imprisonment for tampering with physical evidence. The sentences were ordered to be served consecutively and he was given 417 days credit for time served towards his sentence.
Issues: Whether 1) the district court erred in overruling Appellant’s motion to suppress; and 2) there was insufficient evidence presented at trial to prove beyond a reasonable doubt that Appellant’s statement was voluntary.
