Proceedings below: Appellant was sentenced to life in prison after being convicted of First-Degree Felony Murder, Use of a Weapon to Commit a Felony, and Possession of a Deadly Weapon by a Prohibited Person. Appellant filed a Motion for Postconviction Relief and requested the appointment of counsel, and the district court denied his Motion for Postconviction Relief without an evidentiary hearing and denied his request for appointment of counsel. Life imprisonment cases are automatic and direct appeals to the Nebraska Supreme Court.
Issues: On appeal, Appellant makes the following assignments of error: 1) The district court erred by denying Cox’s motion to add exhibits 1-15 as attachments to his postconviction motion; and 2) The district court erred by denying Cox’s motion for postconviction relief without an evidentiary hearing; and 3) The district court erred by denying Cox's motion for appointment of counsel.
