Proceedings below: Appellant was found guilty of Second-Degree Murder and Use of a Weapon (Not a Firearm) to Commit a Felony, and the district court sentenced him to consecutive terms of sixty-five (65) years to life in prison and forty (40) years to fifty (50) years in prison, respectively. Life imprisonment cases are direct appeals to the Supreme Court.
Issues: Appellant makes the following assignments of error: 1) The district court abused its discretion by imposing an excessive sentence upon Appellant; and 2) The district court abused its discretion in imposing an excessive sentenced upon Appellant by instituting a de facto life sentence in violation of his due process rights and Eighth Amendment rights.
