Proceedings below: Appellant was charged with distribution of a controlled substance and possession of drug paraphernalia. When his plea in bar was denied, he appealed to the Nebraska Supreme Court, which affirmed the district court in State v. Dolinar, 315 Neb. 257, 995 N.W.2d 18 (2023). On remand, the district court denied his motion for absolute discharge. On its own motion, the Court ordered that this case be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant assigns the following error: The district court erred in denying Appellant’s motion for absolute discharge under Neb. Rev. Stat § 29-1207, where the State failed to meet its burden of proof to show that good cause existed sufficient to toll Appellant’s speedy trial rights.
