Proceedings Below: Appellant filed a Motion for Discharge and alleged that her due process and speedy trial rights were violated, which the trial court overruled. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignments of error: 1) The lower court erred in making a general finding that Defendant was not entitled to an absolute discharge under Neb. Rev. Stat. § 29-1207; and 2) The lower court erred in finding that Defendant was not entitled to an absolute discharge for violation of her speedy trial rights and/or due process rights under either the Nebraska Constitution’s or the U.S. Constitution’s due process clause.
