Issues: Appellant assigns the following errors: 1) the district court clearly erred in determining that the performance of the Defendant’s trial counsel was not constitutionally and practically ineffective and that Appellant should not be granted postconviction relief under the Nebraska act and a new trial be ordered; and 2) the district court clearly erred in determining that Appellant’s trial counsel was not ineffective in challenging the State’s DNA evidence presented at trial.
