Proceedings below: The court denied Appellants’ respective Motions for Absolute Discharge. The State filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.
Issues: 1. The district court erred in denying Appellants’ motions for absolute discharge as Appellants were not brought to trial within the statutory time under Neb. Rev. Stat. § 29-1207 (Reissue 2016). 2. The district court erred in denying Appellants’ motion for absolute discharge based upon a constitutional right to a speedy trial.
