S-22-0867 State of Nebraska (Appellee) v. Sheena Hammond (Appellant)
Appeal from District Court for Gage County, Judge Ricky A. Schreiner.
Attorneys: Lee M. Timan (Nelson, Clark & Timon, P.C. for Appellant) and Teryn R. Blessin (Asst. Attorney General for Appellee).
Criminal: Possession of a Controlled Substance, Possession of Drug Paraphernalia.
Proceedings below: Appellant filed a Motion to Suppress evidence found during a traffic stop, but the district court overruled the Motion. After a trial on stipulated facts, the district court convicted Appellant of Possession of Controlled Substances and Possession of Drug Paraphernalia and sentenced Appellant to thirty-six (36) months of probation. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignments of error: 1) The lower court erred in overruling Appellant's Motion To Suppress; 2) The lower court erred in overruling Appellant's objections, at trial, to the admission of evidence presented by Appellee; and 3) The evidence was insufficient to support the Court's verdicts of guilt, because a rational trier of fact could not have concluded Appellant had committed all the essential elements of the offenses beyond a reasonable doubt.
