Proceedings Below: Following the court’s denial of Hartzell’s motion to suppress evidence and admissions on constitutional grounds, a bench trial ensued. At the close of the trial Hartzell was found guilty of Possession of a Controlled Substance. Following a presentence investigation and sentencing hearing, Hartzell was sentenced to two years’ probation.
Issues: Whether the trial court erred when it denied Hartzell’s motion to suppress the evidence and incriminating statements, stemming from a traffic stop and search that Hartzell contends was in violation of the Fourth and Fourteenth Amendments.
