Issues: 1. Whether the trial court erred in dismissing the application for postconviction relief because the statute of limitations under Neb. Rev. Stat. §29-3001(4) had run since the statute of limitations was tolled by his filing of a motion for new trial and subsequent final disposition of that matter, and 2. If the statute of limitations under Neb. Rev. Stat. §29-3001(4) is not actually tolled during the time of the litigation of the motion for new trial, newly discovered evidence, it should be equitably tolled under these facts.
