Proceedings below: The district court denied Appellant’s motion to transfer to juvenile court. After a plea offer, Appellant entered no contest pleas to the three charges. He was sentenced 15-20 years for assault, 15-20 years for robbery and 5-20 for use of a firearm. All sentenced were ordered to be served consecutively.
Issues: 1. The trial court erred by failing to transfer this proceeding to the separate juvenile court when the State failed to satisfy its burden of proving a sound basis for retention of a juvenile case in the district court. 2. The trial court erred by refusing to sentence the Defendant under the
Nebraska Juvenile Code, and imposed an excessive sentence by failing to consider the juvenile’s age, mentality, education, experience, and his social and cultural background.
