Proceedings below: Following a jury trial, Appellant was found guilty on two counts of robbery and sentenced to 30 to 50 years imprisonment. Appellee filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.
Issues: 1) The district court erred in overruling Appellant's motions to suppress, 2) the evidence at trial was not sufficient for the jury to find the Appellant guilty beyond a reasonable doubt or either count of robbery, 3) the district court erred in overruling the Appellant's motion for a new trial, 4) the district court erred in admitting into evidence gruesome photographs of the victims of the robberies, and 5) the district court erred in finding the Appellant to be a habitual criminal pursuant to Neb. Rev. Stat. ' 29-2221.
