Douglas County, Judge Peter C. Bataillon

Attorneys: Stacy M. Foust (Attorney General's Office) ' Beau Finley (Finley & Kahler PCLLO) and Sean M. Conway (Dornan Lustgarten & Troia PCLLO) (Appellant)

Criminal: First Degree Murder; Use of a Firearm to Commit a Felony; Possession of a Deadly Weapon by a Prohibited Person

Proceedings below: After a trial, Appellant was found guilty of all three counts. She was sentenced to life in prison for first degree murder; 40-50 years each on the remaining two counts. Each sentence was ordered to run consecutive with one another.

Issues: I. The district court erred in admitting evidence of Appellant making threats to her mother while carrying a firearm subsequent to the homicide of Curtis Bradford. II. The district court erred in admitting additional evidence of Appellant possession a firearm prior to and following the homicide of Curtis Bradford. III. The district court erred in admitting into evidence gruesome photographs of Curtis Bradford following his homicide. IV. The district court erred in refusing to allow Appellant to elicit impeachment evidence of Ashley Paggan concerning any misconduct by, and discipline of, members of the Douglas County Crime Lab in which she worked. 5. The evidence at trial was not sufficient for the jury to find Appellant guilty beyond a reasonable doubt of any offense charged against her.
