Criminal: Motion to transfer

Proceedings below:  Appellant, a minor, was charged first-degree sexual assault, and he filed a motion to transfer his case to juvenile court.  The district court denied the motion.  On appeal, the Court of Appeals determined that the district court abused its discretion and reversed and remanded the case with directions to transfer the matter to juvenile court.  See State v. Jeremiah T., A-24-0815, (April 22, 2025).  Appellee petitioned for further review, which the Supreme Court granted, ordered that this case be transferred to its docket, and expedited oral argument.   

Issues:  Appellee assigns the following error on petition for further review:  The Court of Appeals erred in concluding that the district court abused its discretion in denying Jeremiah T.’s motion to transfer his case to the juvenile court.
