S-24-0618 State of Nebraska (Appellee) v. Keloni Jones (Appellant)
Appeal from the District Court for Douglas County, Judge LeAnne M. Srb
Attorneys: Keith Dornan (Dornan, Troia, Howard, Breitkreutz, Dahlquist & Klein PC LLO for Appellant) and Nathan A. Liss (Asst. Attorney General for Appellee)
Criminal: Plea: Manslaughter; Use of a Deadly Weapon During the Commission of a Felony; Sentencing
Proceedings Below: Appellant pled no contest to manslaughter and use of a deadly weapon to commit a felony. The district court initially sentenced Appellant to two consecutive terms of twenty (20) years to twenty (20) years in prison but later modified the sentence to nineteen (19) years three-hundred-sixty-four (364) day to twenty (20) years in prison consecutive to a sentence of twenty (20) years to twenty (20) years in prison. Appellee filed a petition to bypass the Nebraska Court of Appeals, which the Nebraska Supreme Court sustained and transferred this case from the docket of the Nebraska Court of Appeals to its docket.
Issues: Appellant assigns the following errors: 1) The district court erred in modifying the valid sentence they originally pronounced; 2) The district court erred in applying the doctrine of inadvertent mispronouncement; 3) The district court abused their discretion in the excessive prison sentence imposed.
