Case Summary

S-23-1039 State of Nebraska (Appellee) v. William B. Langley (Appellant)

Appeal from the Nebraska Court of Appeals on appeal therefrom the District Court for Scotts Bluff County, Judge Leo Dobrovolny

Attorneys: Helen O. Winston and Jessica R. Meyers (Scotts Bluff Public Defender’s Office for Appellant) and Melissa R. Vincent (Asst. Attorney General for Appellee)

Criminal: Motion to suppress and possession of a firearm by a prohibited person

Proceedings Below: Appellant was convicted of possession of a firearm by a prohibited person, and on appeal to the Nebraska Court of Appeals, he argued that the district court erred in overruling a motion to suppress.  The Nebraska Court of Appeals affirmed in State v. Langley33 Neb.App. 297, 15 N.W.3d 722 (2024).  Appellant petitioned for further review, which the Nebraska Supreme Court sustained and ordered that this case be transferred to its docket.

Issue:  In his petition for further review, Appellant assigns the following error:  The Nebraska Court of Appeals erred by finding that the handgun seized was not the fruit of an illegal search.
