Proceedings Below:  The trial court found Appellant guilty of Count I, Sexual Assault on a Child in the First Degree, a Class 1B Felony; Count II, Sexual Assault on a Child in the First Degree, a Class 1B Felony; Count III, Attempted Sexual Assault on a Child in the First Degree, a Class II Felony; Count IV, Sexual Assault on a Child in the Third Degree, a Class IIIA Felony; Count V, and Incest (Victim 17 or Under), a Class IIA Felony. The Appellant was sentenced to an aggregate sentence of 112 years to life in prison and was given credit for 301 days served.

Issues:  Whether 1) the trial court erred and abused its discretion granting the State’s motion to allow evidence that the Appellant sexual assault of the victim in Iowa; 2) the trial court erred and abused its discretion denying Appellant’s Neb. Rev. Stat. § 27-412 motion; 3) Appellant received ineffective assistance of counsel; 4) the trial court provided valid jury instructions; 5) the trial court failed to give limiting jury instructions; 6) the Appellant received an excessive sentence; and 7) Appellant has preserved his postconviction claims.
