S-24-0001 State of Nebraska (Appellee) v. Lenhart (Appellant)
Appeal from the District Court for Dawes County, Judge Travis P. O’Gorman
Attorneys: Robert W. Kortus (Nebraska Commission for Public Advocacy for Appellant) and Melissa R. Vincent (Assistant Attorney General for Appellee)
Criminal: Intentional Child Abuse Resulting in Death and Life Imprisonment
Proceedings below: Appellant was convicted of intentional child abuse resulting in death and sentenced to not less than sixty (60) years in prison and not more than life imprisonment. Life imprisonment cases are direct appeals to the Nebraska Supreme Court.
Issues: Appellant makes the following assignments of error: 1) The district court clearly erred and abused its discretion in denying the motion for mistrial which denied Appellant a fair trial and violated due process; and 2) The district court clearly erred and abused its discretion in admitting as a stipulation representations of facts over the objection of the defense and thereby denied Appellant a fair trial and violated due process.
