Criminal: Operating a motor vehicle to avoid arrest and driving under suspension
Proceedings Below: Appellant was found guilty of operating a motor vehicle to avoid arrest and driving under suspension. The district court sentenced him to thirty-six (36) months of probation for operating a motor vehicle to avoid arrest and fined him $100 for driving under suspension. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignments of error: 1) The district court erred in overruling Appellant’s motion to suppress; 2) The driving under suspension conviction was not supported by sufficient evidence as the State failed to show notice of suspension to Appellant; and 3) There was insufficient evidence as to the flight to avoid as Appellant was never told he was under arrest.
