Proceedings Below: Appellant pled to second-degree murder, and the district sentenced him to not less than life in prison and not more than life in prison. Life imprisonment cases are direct appeals to the Nebraska Supreme Court.
Issues: Appellant assigns the following errors: 1) The district court erred when it denied the Appellant a hearing under Franks v. Delaware, 438 U.S. 154 (1978), when there existed evidence that was false in the affidavit for search warrant herein; and 2) The district court erred and abused its discretion when it sentenced Appellant to not less than life but no more than life in this case.
