Criminal: Attempted intentional child abuse resulting in death
Proceedings Below: Appellant entered a no contest plea to attempted intentional child abuse resulting in death, and the district court sentenced him to forty (40) to fifty (50) years in prison. Appellant requested credit for 971 days served, and the district court credited him with 706 days served. On its own motion, the Supreme Court ordered this case to be transferred from the docket of the Court of Appeals to its docket.
Issues: Appellant makes the following assignments of error: 1) The district court committed error when it refused to grant appellant an additional 266 days of credit against his sentence for the time served in a jail in Guatemala while awaiting extradition for trial; and 2) The district court abused its discretion by giving appellant an excessive sentence.
