S-21-0792 State of Nebraska (Appellee) v. Derek J. Roth (Appellant)
Appeal from the District Court for Dodge County, Judge Geoffrey Hall
Attorneys: Daniel S. Reeker (Kendall, Crawford & Reeker PC, LLO for Appellant) and Melissa Vincent (Attorney General’s Office for Appellee)
Criminal: Plea to Possession of a Deadly Weapon and Third Degree Assault, Revocation of Probation, and sentencing.
Proceedings below: Appellant admitted to two counts of Possession of a Deadly Weapon and one count of Assault. He was sentenced to probation. After Appellant’s probation was revoked, the district court sentenced Appellant to three (3) years in prison for each deadly weapon offense and one (1) year in prison for domestic assault, and all sentences were ordered to be served consecutively on any other charges.
Issues: Whether the trial court erred when it ordered considerable sentences for Mr. Roth in a manner that was excessive and abused the District Court’s discretion in the sentence imposed.
