Criminal:  Life imprisonment for first-degree murder and use of a deadly weapon to commit a felony and tampering with physical evidence

Proceedings below:  A jury found Appellant guilty of first-degree murder, use of a deadly weapon to commit a felony, and tampering with physical evidence.  The district court sentenced him to consecutive prison terms of life in prison, thirty (30) to forty (40) years, and fifteen (15) to twenty (20) years, respectively.  Life imprisonment cases are direct appeals to the Nebraska Supreme Court.

Issues: Appellant assigns the following errors: 1) The district court erred by denying the motion to suppress the arrest of Appellant in Belize, because said arrest violated Belizean immigration law and American extradition procedure; and as a result, the evidence gained from that arrest and detention must be excluded as fruit from the poisonous tree; and 2) There was insufficient evidence presented at trial to sustain Appellant’s convictions such that no rational trier of fact could have found Appellant guilty of the crimes charged.
