Proceedings below: A jury found Appellant guilty of carrying a concealed weapon. On appeal, the conviction was reversed by the Court of Appeals. See State v. Senn, 24 Neb. App. 160 (2016). The State of Nebraska filed a Petition for Further Review which was granted by the Nebraska Supreme Court.

The Court of Appeals erred in applying a civil case proposition of law to a criminal case where the proposition states an appellate court will decide a case on the theory on which it was presented in the trial court. 2. The Court of Appeals erred in finding the evidence insufficient for a rational trier of fact to conclude Senn was guilty of carrying a concealed weapon.
