Proceedings below: The district court overruled Appellant’s motion to suppress and he was convicted following a stipulated bench trial. The Court of Appeals affirmed. Appellant filed a petition for further review which was granted by the Nebraska Supreme Court.
Issues: The Court of Appeals erred by 1) failing to find that Appellant’s motion to suppress should have been sustained, and 2) failing to suppress the evidence because the warrantless search of the Appellant violated the Fourth Amendment
