Case Summary

S-22-0266 State of Nebraska (Appellee) v. Ty W. Sullivan (Appellant)

Appeal from the District Court for Seward County, Judge James Stecker

Attorneys:  Korey L. Reiman (Seward County Public Defender for Appellant) and Kimberly A. Klein and Melissa R. Vincent (Asst. Attorneys General for Appellee).

Criminal:  Post-Release Supervision

Proceedings below:  After being released from prison for a felony child abuse conviction, the trial court modified Appellant’s post-release supervision to require him to follow sex offender specific recommendations as directed by his probation officer.  Appellant’s petition to bypass the Court of Appeals was sustained, and this case was transferred to the docket of the Supreme Court.

Issues:  Appellant makes the following assignments of error: 1) The District Court erred when it modified the Conditions of Post-Release as a matter of law; and 2) The State failed to provide sufficient evidence of new circumstance to support the modifications.
