Proceedings below: The district court denied Appellant’s motion for postconviction relief without an evidentiary hearing.
Issues: The district court erred in 1) denying postconviction relief and an evidentiary hearing on Appellant’s claims of ineffective assistance of counsel, including a) failing to raise 4th Amendment objections to evidence and testimony introduced at trial that was the subject of an unsuccessful suppression motion to preserve the question of admissibility for appeal, b) failing to raise objections to all the hearsay testimony about where the gun used in the homicide was found, c) failing to timely object to the prosecutor’s misconduct during the closing arguments in violation of U.S. due process and fair trial rights, and d) cumulative error violated his U.S. and Nebraska Constitutional rights to due process, fair trial, and effective assistance, and 2) denying the appointment of counsel.
