S-19-0604 State of Nebraska v. John E. Thelen (Appellant)
Cedar County District Court, Judge Paul J. Vaughan
Attorneys: Bradley C. Easland (Egley, Fullner, Montag, Morland & Easland, P.C., for Appellant) – Douglas J. Peterson, Matthew Lewis (Office of the Attorney General, for Appellee)
Criminal: Insufficient evidence; Sentencing
Proceedings Below: The county court found Appellant guilty of three counts of obstructing a roadway and was fined $100 for each count plus court costs. Appellant appealed the county court’s decision to the district court which affirmed the same. Appellant timely appealed the district court’s decision.
Issues: Whether the 1) evidence was sufficient for the county court to find the Appellant guilty of three counts of obstructing a roadway; 2) Appellant’s action of placing an electric fence in a ditch violates Neb. Rev. Stat. 39-301; and 3) district court erred in upholding the finding of the county court.
