Proceedings below: The trial court denied Appellant's motion to suppress evidence. After a trial to the court, Appellant was found guilty and sentenced 1-2 years in prison. The State filed a Petition to Bypass the Court of Appeals which was granted by the Nebraska Supreme Court.

Issues: The court erred in (1) denying Appellant's motion to suppress his statements made during the course of his polygraph interview; (2) denying Appellant's motion to suppress the statements made by the victim which were obtained through use of the statements made by Appellant during his polygraph interview; (3) finding Appellant guilty of the charged crime.
