S-16-1004 State v. Nico M. Wofford (Appellant)
Douglas County District Court, Judge Duane C. Dougherty
Attorneys: Austin N. Relph (Attorney General’s Office) --- Ernest H. Addison, Jr. (Appellant)
Criminal: Excessive sentence; discharging firearm in an inhabited house; use of weapon to commit a felony
Proceedings below: Following a jury trial, Appellant was convicted and sentenced to 20 to 30 years on each of two counts, to run consecutively.
Issues: The district court erred in 1) sustaining the State’s motion to consolidate and overruling Appellant’s objection to the same, 2) overruling and denying Appellant’s objection and challenge to the jury selection in this matter, 3) failing to find the evidence presented lacked the probative value to sustain a guilty verdict, 4) allowing the jury unsupervised and unfettered access to view the crime scene video during deliberations and by failing to exercise the court’s discretion to have denied the same, 5) imposing an excessive sentence.
