S-21-0294 State v. Antoine Young (Appellant)
Douglas County District Court, Judge Peter C. Batallion
Attorneys: Melissa R. Vincent (Attorney General’s Office) --- Rachel K. Wester & Tricia Rojo Bushnell (Midwest Innocence Project) & Tracy Hightower-Henne (Hightower Reff Law)(Appellant)
Civil: Postconviction
Proceedings below: The district court denied Appellant’s motion for postconviction relief following an evidentiary hearing.
Issues: Whether the district court erred in 1) holding Appellant’s claims were procedurally barred, 2) denying relief because Appellant received ineffective assistance of trial counsel in violation of the Sixth and Fourteenth Amendments to the U.S. Constitution and Nebraska Constitution Art. I, §§ 3 and 11, 3) denying relief because Appellant’s convictions were obtained as the result of the State’s knowing use of false testimony in violation of Appellant’s constitutional rights and the decisions in Mooney v. Holohan, 294 U.S. 103 (1935), Napue v. Illinois, 360 U.S. 264 (1959), and their progeny, and 4) failing to address Appellant’s claim that his convictions were obtained as the result of the suppression of material exculpatory evidence in violation of Appellant’s constitutional rights under Brady v. Maryland, 373 U.S. 83 (1963), and its progeny.
