Proceedings below: Appellant filed a Motion to Show Cause against Appellee for allegedly violating the Parenting Plan. After the district court declined to issue an Order to Show Cause against Appellee, the Nebraska Supreme Court, in Vyhlidal v. Vyhlidal, 309 Neb. 376, 960 N.W.2d 309 (2021), remanded the matter back to the district court. On remand, and after a hearing, the district court found that Appellee was not in willful contempt of court.
Issues: Appellant argues that the district court abused its discretion in failing to hold Appellee in contempt of court because the district court: 1) committed clear error in its interpretation of the parenting plan; 2) improperly failed to find Appellee violated the parenting plan; and 3) abused its discretion in not finding Appellee’s violation of the Parenting Plan willful.
