Civil Action: Child Support Modification

Action Taken by the Trial Court: After trial, the district court found that Appellee’s earning capacity should be reduced to minimum wage. A child support calculation based on that figure resulted in a monthly obligation of $1. The court determined that to be a de minimus amount and thus reduced Appellee’s child support obligation to $0 per month. The district court further ordered that the parties equally split expenses incurred on behalf of their minor child. Appellant moved the court to reconsider its decision, which motion was denied.

Assignments of Error on Appeal: Appellant assigns that the district court erred in (1) finding Appellee’s earning capacity should be reduced, (2) reducing Appellee’s child support obligation, (3) ordering the parties to equally share expenses incurred on behalf of the minor child, and (4) denying Appellant’s motion to reconsider.
