Juvenile Action: Change in Permanency Objective; Jurisdiction

Action Taken by Trial Court:  The juvenile court continued all services previously ordered but changed the permanency objective from reunification to guardianship.

Assignments of Error on Appeal:  The appellant father appealed contending he was denied due process and a fundamentally fair procedure and that the State did not meet its burden to establish that the change in permanency objective from reunification to guardianship was in the children’s best interests. He further contends that the change in permanency objective was not supported by the evidence. The Court of Appeals has ordered the parties to address the issue of jurisdiction in their briefs relating to whether the order appealed from is a final, appealable order.
