Action Taken by Trial Court: The district court denied Appellant’s amended motion for postconviction relief without an evidentiary hearing on the bases that the arguments for relief were not pled with sufficient specificity and the record affirmatively established that the claims were without merit.
Assignments of Error on Appeal: Appellant contends that the district court erred in denying his amended motion for postconviction relief without an evidentiary hearing. He has identified 13 assignments of error on appeal which can be divided into three specific areas: (1) the violation of his due process rights due to insufficiency of the evidence to support his convictions based upon his claim that the identification procedures used by law enforcement resulted in his misidentification as the shooter; (2) the ineffectiveness of trial counsel both prior to and during his trial; and (3) the ineffectiveness of his appellate counsel.
